Welcome to DyslexAbility Pty Ltd (“DyslexAbility,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of our services, including all programs, courses, workshops, digital platforms, and any other services provided by DyslexAbility (collectively referred to as the “Services”). By using our Services, you agree to be bound by these Terms of Use.

 

1. Scope of Services

DyslexAbility provides tailored educational support, literacy and numeracy intervention programs, social skills development, and other related services to individuals with neurodiverse learning needs. Our Services are designed to support children, young people, and families through personalised intervention programs and learning solutions.

 

2. Client Obligations

By engaging with DyslexAbility, you agree to:

  1. Provide Accurate Information: You must provide accurate and up-to-date information when enrolling or booking our Services.

  2. Comply with Policies: You agree to adhere to DyslexAbility’s policies, including this Terms of Use, Privacy Policy, and any other applicable policies and procedures.

  3. Responsible Participation: You must ensure that you and/or your child participate in DyslexAbility’s programs in a respectful and responsible manner.

  4. Health and Safety: Inform DyslexAbility staff of any relevant medical or behavioural concerns that may impact your or your child’s participation in our programs.

 

3. Booking, Payment, and Cancellations

3.1 Booking Process

  • All bookings are subject to availability and confirmation by DyslexAbility.

  • Bookings can be made via phone, email, or online (if applicable).

 

3.2 Payment Terms

  • Payment is due on the date of the session or paid for in advance.

  • Any unpaid invoices must be paid no later than the due date stipulated on the invoice.

  • Invoices for NDIS clients will be emailed to their plan managers.

 

3.3 Cancellation Policy

Regular attendance is essential, as our Practitioners dedicate significant time to preparing tailored lesson plans for each client. DyslexAbility operates on a term-based commitment, not a session-by-session basis.

  • If a cancellation is initiated by the client, the full-service fee will be charged.

  • If DyslexAbility cancels a session, a pro-rated credit or adjustment will be applied to your account for the portion of the cancelled session, based on the overall cost of the term’s service fees.

  • While we understand that unforeseen circumstances such as illness may arise, all sessions must still be paid for, as our fees also cover practitioner preparation, assessments, and administrative work.

 

We appreciate your understanding and cooperation in helping us maintain the high-quality service we strive to provide.

 

4. Promotional Offers – Terms & Conditions

4.1 Offer Validity

  • Any promotional offer is available for a limited time only, as advertised by DyslexAbility.

  • Promotions are subject to availability and may be changed or withdrawn at any time without notice.

 

4.2 Eligibility & Restrictions

  • Promotional offers cannot be used in conjunction with any other discounts, promotions, or offers unless stated otherwise.

  • Each offer applies only to the specific services or packages outlined in the promotion.

  • Eligibility criteria (e.g., Early Bird discounts, Sibling Discounts, or Multiple Family Discounts) will be clearly stated in each promotion.

 

4.3 Payment & Booking

  • Full payment is required at the time of booking to secure the promotional price, unless otherwise stated.

  • Discounts apply only to new bookings made within the promotional period.

  • Payment for promotional offers must be made by the due date; otherwise, the price will revert to the full standard pricing for the service.

 

4.4 Non-Transferable & Non-Refundable

  • Promotions and associated services or packages are non-transferable and cannot be shared or used by another person unless specifically stated.

  • Discounts and offers are non-refundable and cannot be exchanged for cash or credit.

 

4.5 Changes & Cancellations

  • DyslexAbility reserves the right to modify, extend, or cancel any promotion at any time without prior notice.

  • Cancellations and changes are subject to DyslexAbility’s standard cancellation policy.

 

4.6 Additional Terms

  • Additional conditions may apply to specific promotions. By booking, you agree to comply with all applicable terms.

 

5. Intellectual Property

All content provided by DyslexAbility, including written materials, logos, designs, and digital resources, is protected by intellectual property laws. You agree not to reproduce, distribute, or share any content without the express written consent of DyslexAbility.

 

6. Liability and Disclaimers

  • DyslexAbility aims to provide a safe and supportive environment; however, we do not guarantee specific outcomes from our programs.

  • We do not accept responsibility for any indirect, incidental, or consequential loss or damage arising from the use of our Services.

7. Privacy and Confidentiality

  • DyslexAbility is committed to protecting your privacy. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal information.

  • Any information shared during sessions or related communications will remain confidential, except where disclosure is required by law or with your consent.

 

8. Changes to Terms of Use

We reserve the right to update or modify these Terms of Use at any time. Any changes will be communicated via email or through our website. Continued use of our Services after such changes constitutes your acceptance of the new terms.

9. Feedback and Complaints

9.1 Feedback and Complaints Management

The DyslexAbility Privacy and Dignity Policy contains information about how you can access the personal information we hold about you, how you can make a complaint about a breach of your privacy or the Privacy Act and how we will deal with your complaint (i.e., in accordance with our Feedback and Complaints Management Policy).

 

Any breach or alleged breach of your privacy will be taken seriously. In each case, the incident must be reported and managed in accordance with our Incident Management System set out in our Incident Management and Reporting Policy.
